Hey everyone, I wanted to start a discussion on something that most Indian employers are completely overlooking — the legal side of Work From Home.
Since 2020, WFH has become a permanent model for many companies in India. But here is the thing — most employers are still running remote teams without understanding their actual legal obligations. This can lead to serious compliance issues down the line.
Some key questions that every employer should be asking:
- Are work from home employees covered under the Shops &
Establishment Act? - What are the data privacy rules for remote workers?
- Is there any fixed policy on work hours for WFH employees?
- What about employee benefits — are they different for
remote workers? - How should employers handle equipment and internet
reimbursements legally?
I recently went through this WFH laws in India employer guide and honestly it answered most of my questions. It covers everything in simple language — no heavy legal terms, just practical information that any HR team or business owner can understand.
A few things I found really useful in it:
- Clear breakdown of IT Act implications for remote work
- How labour laws apply differently to WFH employees
- What a proper WFH policy should include
- Employer responsibilities around data security
If you are running a remote team or planning to shift to a hybrid model in 2025, I strongly suggest going through this once. It could save you from a lot of legal trouble.
Would love to hear from others — how is your company handling WFH compliance? Are you following any specific policy or just going with the flow?
Let's discuss!
