Make sure all residency criteria are satisfied and that all matters, such as property, child custody, and maintenance, are agreed upon by both parties before filing for an uncontested divorce in New York. Submit the Settlement Agreement and a Summons with Notice or a Summons and Complaint to the relevant county court. Fill out the required paperwork, such as the divorce judgment and the plaintiff's affidavit. Send in documentation for judicial review. Without a trial, the divorce is finalized with the court's approval.
